TheInsuranceLeads.com (the "Site") is owned and operated by Versatile Reserve LLC ("we," "us," "our"), 30 N Gould St, Sheridan, WY 82801. By placing an order or using the Site you agree to these Terms.
1. Services
We sell aged and real-time opt-in insurance leads across multiple categories (including Health/ACA, Medicare, Final Expense, and Life), bulk consumer data, and related delivery services via API or file formats.
2. Orders and payment
Every tier carries a per-tier lead-count minimum as published on the Pricing page, unless otherwise agreed in writing. Payment must be received in full before delivery. Payment instructions are provided with each invoice. Returning buyers may be offered terms at our discretion. Prices shown on the Site are subject to change without notice; the price confirmed by us at order acceptance governs.
3. Exclusivity
All leads sold through the Site are 100% exclusive: each lead is delivered to one buyer only and is not redistributed by us after delivery.
4. Ownership of delivered data
Upon receipt of full payment, ownership of the delivered lead records transfers to the buyer. Buyers may use the data for lawful insurance marketing and solicitation. Buyers may not resell, license, or redistribute the data to third parties without our written permission.
5. Compliance
Leads are generated from consumers who submitted a request for insurance information. Buyers are solely responsible for their own compliance with the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule, CAN-SPAM, state telemarketing and insurance regulations, Do-Not-Call requirements, and CMS marketing rules where applicable, in how they contact and use the data.
6. Buyer obligations
Buyers represent that they are licensed insurance agents, agencies, brokers, or marketing organizations, or otherwise lawfully permitted to purchase and use the data, and that the data will be used solely for lawful purposes.
7. Prohibited uses
Unlawful activity, spam, unauthorized robocalling or prerecorded messaging, harassment, discrimination, identity fraud, and unauthorized resale are prohibited. We may refuse or cancel orders from buyers who violate this section.
8. Refunds and replacements
All sales are final. We do not issue refunds. We will replace leads for documented delivery errors (for example, records outside the ordered states or a disconnected-number rate materially above industry norms) reported in writing within 72 hours of delivery. Replacement is the sole remedy.
9. No guarantee of results
We make no guarantee of contact rates, conversion rates, or sales results. Data is provided "as is" with respect to accuracy and completeness of consumer-supplied information.
10. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to an order shall not exceed the amount paid for that order. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Indemnification
Buyer agrees to indemnify and hold harmless Versatile Reserve LLC and its officers, members, and contractors from claims arising out of buyer's use of the data, including any regulatory or consumer claims.
12. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming.
13. Changes
We may update these Terms at any time by posting a revised version on the Site. Continued use after posting constitutes acceptance.
